  • Abstract For the implementation of the policy, Public Works is an important project. Public Works also affects the satisfaction of the government. The quality of Public Works is not good, because the Government Procurement System has some flaws. Government Procurement Law started since 2000. It has been amended several times. The law has also been very complete, but the complains about it are more and more than before. Public Works Procurement System is modified several times, too. It is not good enough to everybody. One of the reasons is the interactions between the system and behavior. The interactions make law and system to run unsmooth. Institutionalism thinks that the interaction between system and individual behaviour will result in the evolution of the institution. The institution will be changed in an emergency. The institution changes will be limited by path dependence factors. This study found that the more changes in the system would not be better. The existing functions will restrict the changes of institution. Especially, the actors will not necessarily improve performance after the institution change. Institution change functions and benefits may not develop positively. Public Works Procurement System is restricted by its essence. The change will be limited in some detail. If the essence does not change, the effects of improvement will not be good.
